For those of you that offer party favors, hats, blow up bats etc. Do you guys have a clause in your contract saying that you are not liable for any harm done with your party favor products? Even if you don't whats your opinoins and did you guys ever have any problems?

We don't mention anything about it at all in our contract, we sell the favors, so once they buy them, they can do what they want with them.. our contract is only for the services we offer, not the products we sell. If you sell them, I wouldn't see how you could be held reliable for anything.. just like going to WalMart and buying something.. I don't know though with the laws now days.. contact your lawyer and ask their feedback.

We are under the same opinion as Joe. Once they buy props they are the property of the B&G and guests. We are contracted as a service, not a toy manufacturer. Look at it this way. If you purchase a toy fire engine from Toys-R-Us and your child injures themself playing with it. You don't sue Toys-R-Us you go after the manufacturer, or the kid who hit him over the head with the toy fire engine.
